I-9 Forms are Changing

Employers should be reminded of the upcoming end of Covid-19 flexibility pertaining to I-9 record keeping. The Form I-9 is used to verify employment authorization and identity when a company hires a new employee. Historically, this has required in-person review of original documents. During the pandemic, USCIS provided a temporary policy where review of the documents could be done by remote means. This permitted an employer to defer inspection of the original documents. That deferral period is coming to an end. Here are some important dates to remember:

July 31, 2023: This is the last day that employers may inspect documents by remote means.

August 30: 2023: Employers who took advantage of reviewing documents by remote means MUST go back and complete an in-person physical review of all associated original documents no later than this date.

If an employer used an authorized representative on their behalf to inspect original documents at the time of I-9 completion, a new physical document review does not need to be performed.
